Terms and Conditions
Effective
These terms apply when you use ecanenterprises.ca, ask us for a quote, or buy products or services directly from ECAN Enterprises. Please read them before you buy. "We", "us", and "ECAN" mean ECAN Enterprises. "You" means the customer.
Your legal rights come first. If you are a consumer, nothing in these terms limits your rights under Ontario's Consumer Protection Act, 2002, the Sale of Goods Act, or any other law that cannot be waived. If anything here conflicts with those rights, your rights win.

Our full business contact details, including our legal name, telephone number, and business address, are included in every written quote, order confirmation, and agreement we send you before you commit to a purchase.
2. What these terms cover
These terms cover this website, quotes, and products and services you buy directly from us, including through any online store we run in the future. Some purchases have extra documents:
- A written quote, work order, order confirmation, or project agreement can add details or change these terms for that job. If one of those documents conflicts with these terms, the document wins.
- Purchases made through Amazon.ca, eBay, Facebook Marketplace, Kijiji, or another marketplace are covered by that marketplace's terms. See Marketplace purchases.
- Our Privacy Policy explains how we handle personal information.
3. Quotes
- Sending a quote request through our website or by email does not create a contract. The website form only opens a draft in your own email app.
- A quote is an offer we make to you in writing. Unless it says otherwise, it is valid for 14 days, because hardware prices and availability change quickly.
- A contract is formed when you accept our written quote or order confirmation, for example by replying to accept it, signing it, or paying a deposit.
- If a quote includes an estimate, we will not charge more than 10% above the estimate unless you approve the higher amount first.
4. Prices and taxes
- All prices are in Canadian dollars.
- The price we quote is the total you pay us. Any delivery or other charge is shown in the quote before you agree. We do not add fees at the end.
- ECAN Enterprises is not currently registered for GST/HST, so we do not charge GST/HST on direct sales. If that changes, tax will be shown as a separate line on quotes and invoices. Purchases made on a marketplace may include tax that the marketplace collects.
- If a price on our website or in a listing is clearly wrong, we will tell you before we accept your order and let you choose whether to continue at the correct price or cancel.
5. Payment
- We accept Interac e-Transfer, credit and debit cards through Stripe or Square, PayPal, and cash at pickup or on-site visits.
- Unless your quote says otherwise, payment is due when you pick up, receive, or approve the finished work.
- Custom builds, special-order parts, and development projects may require a deposit. The amount, what it covers, and when it is refundable are stated in your quote before you pay.
- We never ask for card numbers by email, text, or phone. Card and PayPal payments are processed by the payment provider; we do not see or store full card numbers.
6. Product condition
Each listing or quote states the product's condition:
- New: unused, in the manufacturer's packaging.
- Refurbished: previously used, then inspected, cleaned, repaired or upgraded as needed, and tested by us.
- Used: previously used and working when tested. It may show normal signs of wear, which we describe or photograph.
Before we sell a used or refurbished computer, we check that it powers on and that its main components work, run stress and temperature tests where applicable, and erase all previous data. Battery capacity on used laptops is stated in the listing when we can measure it. Photos are of the actual item unless the listing says they are stock photos.
7. Warranty
New products
New products come with the manufacturer's warranty. We will help you make a claim with the manufacturer.
Used and refurbished products
We warrant used and refurbished hardware against defects for 30 days from the date you receive it. If the item fails in normal use during that time, contact us and we will repair it, replace it with an equivalent item, or refund you. If we cannot repair or replace it, we will refund you.
This warranty does not cover:
- physical, liquid, or electrical damage after you receive the item, or damage from misuse;
- repairs or modifications made by anyone other than us;
- software problems, viruses, or data loss;
- normal wear on batteries and other consumable parts, beyond what the listing describes.
Your legal rights
Our warranty is in addition to your rights under the law, not instead of them. Under Ontario law, goods must be of acceptable quality and fit for the purpose you told us about, and services must be of reasonably acceptable quality. Those rights apply even after our 30-day warranty ends.
8. Returns and refunds
- Change of mind: you may return a product bought directly from us within 14 days of receiving it, if it is in the same condition with all accessories and packaging. We refund the purchase price within 15 days of receiving the return. Unless the item was faulty or not as described, you pay any return shipping.
- Not returnable for change of mind: custom PC builds made to your specification, parts ordered specially for you, and software that has been opened or activated. This does not affect your rights if the item is faulty or not as described.
- Faulty or not as described: contact us and we will repair, replace, or refund, as set out in Warranty. We pay return shipping in these cases.
- Online and distance purchases: you also have the cancellation rights the Consumer Protection Act, 2002 gives for internet and distance agreements. For example, if we do not deliver within 30 days of the promised delivery date, you may cancel and get a full refund.
9. Shipping and pickup
- We ship only to addresses in Canada. Local pickup is available by appointment in London, Ontario.
- The quote or order confirmation states the delivery method, cost, and expected delivery date.
- We are responsible for the item until it is delivered to you or picked up.
- If a parcel arrives damaged, please take photos and contact us within 7 days of delivery so we can file a claim with the carrier and arrange a repair, replacement, or refund.
10. Custom PC builds
- We build to the parts list and price in your accepted quote. If a part becomes unavailable or its price changes, we will offer you an equivalent or better alternative, and we will not change your price without your approval.
- Each part keeps its own manufacturer warranty. Our assembly work is warranted for 30 days from delivery or pickup.
- Builds include a clean operating system install where quoted. Software licences are yours and are subject to the publisher's licence terms.
11. Repairs and upgrades
- We tell you any diagnostic fee before we start. We do not begin paid repair work until you approve the quote or estimate, in writing or by email.
- If we find that the job will cost more than 10% above the estimate, we contact you first. You can approve the new amount or have the device returned, paying only the diagnostic fee and any work you already approved.
- Parts we replace are returned to you on request, unless they are exchanged under a warranty or must be recycled.
- Our repair labour is warranted for 30 days. New replacement parts carry the manufacturer's warranty; used replacement parts carry our 30-day warranty.
- Some devices cannot be repaired economically. If so, we tell you before doing further work.
- For on-site visits, we confirm the work and price with you in writing before the visit.
12. Your data during repairs
- Please back up your data before you bring us a device. Hardware that is already failing, especially drives, can lose data during testing or repair even when the work is done carefully.
- We access your device only as needed for the job and do not browse personal files. See our Privacy Policy for how we handle device data, passwords, and backups.
- Data recovery and backups are only done if they are part of your quote.
- We are responsible for data loss we cause through our own negligence. We are not responsible for data loss caused by a fault that already existed in the device.
13. Uncollected devices
- We contact you when your device is ready. Please collect it and pay within 30 days.
- If a storage fee will apply to devices left after that time, the amount is stated on your work order before we start.
- If a repaired device is not paid for and collected within 60 days after the repair is finished, we may sell it to recover what is owed, as allowed by Ontario's Repair and Storage Liens Act. We will first send you written notice at least 15 days before any sale. All data on the device is erased before it is sold, and any money left over after paying the amount owed is returned to you.
14. Software and web development
- Every development project has a written proposal or project agreement that sets out the scope, price, deposit, schedule, and how changes are approved. That agreement governs the project.
- Work outside the agreed scope is quoted separately and done only with your approval.
- Ownership: unless your project agreement says otherwise, once you have paid in full you own the custom code, designs, and content we create specifically for your project. We keep ownership of our pre-existing tools, code libraries, and know-how, and you receive a permanent licence to use any of them included in your project. Third-party and open-source components remain under their own licences.
- You are responsible for having the rights to any content, logos, and data you give us to use.
- We may list your project in our portfolio only with your permission.
15. Marketplace purchases
When you buy from us on Amazon.ca, eBay, Facebook Marketplace, Kijiji, or another marketplace, the marketplace's terms and buyer-protection programs apply to your order, along with your legal rights. Our 30-day warranty on used and refurbished items also applies unless the listing says otherwise. Contact us through the marketplace's messaging system so the marketplace has a record.
16. Using this website
- The text, photos, logo, and design of this website belong to ECAN Enterprises or are used with permission. You may view and share pages for personal use, but you may not copy them for commercial use without our permission.
- Do not attempt to disrupt, overload, scan for weaknesses in, or gain unauthorized access to this website. If you find a security problem, please report it to contact@ecanenterprises.ca.
- We try to keep website information accurate and current, but product availability and prices can change. Your written quote is the final word on price and specifications.
- Links to other websites, such as marketplaces, are provided for convenience. We are not responsible for their content or privacy practices.
17. Responsibility for loss
If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable or that is caused by events outside our reasonable control. Nothing in these terms limits liability that cannot be limited by law.
If you are buying for a business: to the extent the law allows, our total liability for any claim is limited to the amount you paid for the product or service the claim relates to, and we are not liable for lost profits, lost business, or indirect loss. Project agreements may set different terms.
18. Questions and disputes
- If something goes wrong, please email contact@ecanenterprises.ca first. We aim to reply within 2 business days and to resolve most problems quickly.
- These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Either of us may bring a claim in the courts of Ontario, including Small Claims Court.
- If you are a consumer, you keep any right to bring a claim, or to take part in a class action, that consumer protection law gives you. We do not require arbitration.
- Consumers can also get help from Consumer Protection Ontario.
19. Accessibility
If you need these terms, a quote, or an invoice in another format, or need help using this website or our services because of a disability, email contact@ecanenterprises.ca. We welcome feedback on accessibility and will respond within 5 business days.
20. Changes to these terms
We may update these terms from time to time and will change the effective date at the top of this page. Changes apply only to quotes and orders made after the change. They do not change an agreement you have already made with us unless you agree to the change.
